Overview of the CCIA Laws: Sensitive Locations in New York

Check current law before relying on this section. Courts have changed parts of New York's sensitive-location rules since this guide was written. In Christian v. James (2d Cir., May 18, 2026) the court held the default ban on carrying on private property open to the public unconstitutional, and upheld the ban on carrying in urban public parks against a facial challenge (opinion). The current statute text is at N.Y. Penal Law § 265.01-e (sensitive locations) and § 265.01-d (private property). This site has not re-checked the status of each location. The author's original 2024 reference is kept below for background only, and it is not legal advice.

Detailed Breakdown of Sensitive Locations

Government Buildings and Facilities

All places owned or under the control of federal, state, or local government for the purpose of government administration are considered sensitive locations. This includes:

  • Courts, Police stations, City halls, State capitol buildings, Post Offices, Government DMV offices, Medicaid offices, Housing offices etc.

"Any place owned or under the control of federal, state, or local government, for the purposes of government administration, including courts" is classified as a sensitive location. - New York
Concealed Carry Improvement Act.

Prior to December 2023, firearms were prohibited in all places of worship. Now, however, 1) permission must be obtained through a formal letter from the President, Rabbi, Clergy, or
other authorized leader, signed, preferably notarized, or emailed directly to you, and
2) there must be no clear, conspicuous signage outside of the building that prohibit firearms (unless
the sign states, only authorized personnel permitted all others prohibited).

Educational Institutions

Schools and other educational facilities (this includes parking lots) are strictly off-limits for concealed carry. This category includes:

  • The area bound by Eighth Avenue, Fortieth Street, Sixth Avenue, and Fifty-third Street

  • The area bound by Ninth Avenue, Fortieth Street, Eighth Avenue, and Forty-Eighth
    Street

Exceptions to Sensitive Location Restrictions

While the list of sensitive locations is extensive, there are some exceptions to these
restrictions. The following individuals may be exempt from these prohibitions:

  • Law enforcement officers (active and retired), Security guards with special armed
registration cards (while on duty), Active-duty military personnel, Certain government
employees with express written consent, Individuals engaged in lawful hunting
    activities.

· "These restrictions do not apply to: Federal law enforcement officers carrying pursuant to
the Law Enforcement Officers Safety Act; Police officers; Designated peace officers;
Retired police officers…" - Giffords Law Center.

Private Property Considerations

The Concealed Carry Improvement Act (CCIA) initially included a provision that made
private properties "sensitive locations" by default, requiring owners to explicitly allow
firearms on their premises. However, recent court rulings have challenged this aspect of
the law.

As of the latest updates:

  • Private businesses that are open to the public are no longer considered sensitive
    locations by default.

  • Property owners retain the right to prohibit firearms on their premises.

  • 'Clear and conspicuous' signage is required if firearms are not permitted.

  • PRIVATE HOMES are RESTRICTED, unless you have received 'explicit' permission
    from the homeowner.

Best Practices for Concealed Carry Permit Holders

Given the complexity of sensitive location restrictions, concealed carry permit holders should adhere to the following best practices:

  • It's a Concealed Carry License - make sure your firearm is always CONCEALED!

  • Practice and memorize the 4 fundamental rules of firearms - especially FINGER DISCIPLINE!

  • Stay informed about current laws and regulations, as they may change due to ongoing legal challenges.

  • Assume a location is off-limits unless you have confirmed otherwise.

  • Look for clear signage indicating whether firearms are permitted or prohibited in private establishments.

  • Be prepared to secure your firearm safely if you unexpectedly need to enter a sensitive location.

  • Consider using a smartphone app or carrying a printed list of sensitive locations for quick reference.

  • Keep checking the 2A613 website for the latest rulings and laws.

BE MINDFUL OF THE LAW & ITS RAMIFICATIONS: Being caught with your firearm in a 'Sensitive / Restricted' Location is a CLASS E FELONY in New York State, in addition to losing your License, and your Firearm - consider the legal fees and possible imprisonment. זה לא כדאי.
